Stallion Owner understands & agrees that this donated breeding service includes a live foal guarantee and should the mare fail to produce a live foal in 2012, a return breeding service will be honored the following season in 2012 only.  Refer to published & attached rules including #8 & #34.

ACCEPTING NWSSA TERMS OF APPLICATION

I / We certify that said stallion is at least 2 years old and is free of the following defects: Parrot Mouth (under or over shot) Cryptorchid or Monorchid, is a minimum of 14 hands tall at the withers & does not rack or pace. If stallion has parrot mouth, cryptorchid or monorchid, is positive for HYPP (N/H or H/H), is under 14 hands tall, or does not travel with a true trot, this information must be listed in the published catalog or service will not be sold.   If, said Stallion is accepted into the NWSSA Auction and then later withdrawn for any reason, or fails to appear or have a Get representation at the actual auction,  then the  Stallion Owner shall be assessed a $450 penalty fee.  If the penalty is not paid, the Stallion Owner will be excluded from current and future participation in the Auction & Futurity program.  If NWSSA is not able to make contact with the stallion owner by August 15, 2010, said stallion will be replaced with a stallion on the waiting list.Exception: If stallion should die or becomes unfit for breeding, and a Veterinarian certificate is provided to the NWSSA, no fine will be assessed and a Waiver granted from the NWSSA Committee.  I / We guarantee that if breeding via shipped semen is offered on said stallion his semen meets or exceeds acceptable industry standards for semen quality.  I/We, as the stallion owner, certify that all of the information provided on this contract is true & accurate.   If Contract is accepted, in consideration of allowing my participation in this activity, under the terms set forth herein both this Contract, the NWSSA rules as published and received, I hereby hold harmless and release the NWSSA, its Members, affiliated individuals and organizations, from any and all legal liability. It is also understood that I/We, as the stallion owner, or any entity representing this above named stallion, shall bring no claims, demands, actions and causes of action, and/or litigation, for any economic and non-economic losses due to any bodily injury, death, property damage or perceived loss sustained in relation to the agreement &/or the premises and operations while participating in any & all activities associated with this Stallion's participation in the NWSSA. This Agreement shall be governed by the laws of the state of Washington. If this signed Application/Contract is accepted by the NWSSA, it will then become binding on all parties and participation is subject to this Contract & the 2010 North West Stallion Service Auction Rules, as published and attached.
